Lewistown Company Resolves Opencut Mining Violations
Helena -- The Montana Department of Environmental Quality (DEQ) received a $13,540 administrative penalty in settlement of its enforcement action against MK Weeden Construction, Inc. of Lewistown for violations of the Montana Opencut Mining Act at the Ed Wichman Pit in Pondera County, Montana.
In September 2012, DEQ and Weeden entered into an Administrative Order on Consent citing the company for multiple violations including: conducting opencut operations in a non-permitted area; mining into ground water and creating a non-permitted pond; and failing to mark the permit boundary. Under the Consent Order, Weeden agreed to pay a $13,540 administrative penalty to resolve the violations.
Persons who have questions about the requirements for opencut mining operations may contact DEQ’s Industrial and Energy Minerals Bureau at (406) 444-4970 or should visit DEQ’s web site at www.deq.mt.gov.
